Relating to taxation; making legislative determinations of fact that the distribution of fuel oil in the City of Cocoa Beach, Florida, is a utility service competitive with the distribution of electricity and metered and bottled gas in said city; amending the Cocoa Beach Code by adding at the end of Chapter 24 thereof an article III consisting of 17 sections numbered 24-30 through 24-46 inclusive; imposing and levying a utility service tax by the City of Cocoa Beach, Florida, on each and every purchase of fuel oil within the corporate limits of the City of Cocoa Beach, except those purchases hereinafter specifically excluded and exempted, said tax to be in the amount of ten per centum (10%) of the charge made by the seller to the purchaser for said fuel oil; defining the term "fuel oil" to include all grades thereof, kerosene, and coal oil; declaring the applicability of the tax hereby imposed; providing certain exclusions and exemptions; providing for disposition of the proceeds of the tax hereby imposed; declaring the tax hereby imposed to be continuing in nature; providing in every case that the tax shall be collected from the purchaser and paid by the purchaser for the use of the City of Cocoa Beach to the seller of such fuel oil at the time of paying the charge therefore to the seller; providing for the collection of such tax by the seller of such fuel oil, and declaring it unlawful for any seller of fuel oil to collect from the purchaser therefore without at the same time collecting the tax hereby imposed and levied in respect to such purchase, unless such seller shall elect to assume and pay such tax without collecting the same form the purchaser; providing for the keeping of records, the making of reports and payments over by the sellers of such fuel oil of taxes collected by them from the purchasers thereof; providing for the enforcement of payment by seller be the city of taxes collected; requiring discontinuance of sales to purchasers failing to pay tax; providing monetary penalty upon purchaser failing to pay tax; providing a penalty of fine and/or imprisonment for willful violation of this ordinance; providing that the tax imposed and levied hereunder shall be applicable to purchases of fuel oil made on or after December 7, 1972; providing that invalidity of any portion hereof shall not affect the remaining portions of this ordinance |
